Respected Sir,

Appeal to support Shahabag-centric human rights movement to establish
secularism in Bangladesh and request to ensure safety & security to the lives,
properties and religious institutions of minority communities like Hindu,
Buddhists, Christians, etc.

You are aware that, at the cost of thousands of Bengalis (Hindu & Muslim), Bangladesh
won her freedom in 1971 with the support of Smt Indira Gandhi. India had to dedicate lives of
many soldiers in the freedom fight of Bangladesh to create an atmosphere wherein safety &
security of the minority communities of Bangladesh is ensured. Unfortunately, the dream of
Smt Gandhi did not realize due to the assassination of Sheikh Muzib Rahaman in 1975. The
BNP led government, after Sheikh Muzib, created an anti-minority environment in Bangladesh
and finally in 1988, the constitution of the country was redefined as Islamic country. Similarly, it
enacted many laws to grab properties of these minority communities in addition to serial attacks
on lives, properties and religious institutions of these communities by the fundamentalists of
Muslim community. As a result, the population of minority communities has gone down to 9%
from 29% after independence.

Though late but the good days have come and Shahabag-centric movement is
the commencement of fight to reestablish real democracy against the fundamentalists of
Bangladesh. Nikhil Bharat Bangali Udbastu Samanvay Samiti (NiBBUSS) is a national
umbrella organization of 3.5 crores of Bengali refugees in India; we wholeheartedly support
this democratic humanitarian Shahabag-centric movement. We pray for peace of those great
souls who have lost their lives in reestablishing democracy in Bangladesh! However, the fight
between the fundamentalists & democratic rationalists, the innocent minorities are losers. The
cost is too high for them in terms of lives, properties, religious institutions as well as prestige of
women-folks. In this context, they have only 2 choices before them, either to leave the country
or the religion.

In light of the above discussion, we request your kind & appropriate interventions to
make the Shahabag movement successful and to ensure safety & security to the minority
communities at the earliest so that those 1.5 crores of minority communities need not become
refugee in India to retain their religion & lives. We also expect that your able leadership

अरविन्द स्मृति का चंडीगड़ के अपने ''जाति -प्रश्न और मार्क्सवाद " में ब्राह्मणवादी दावा करते है की डॉ आंबेडकर चिन्तक के रूप में विफल रहे क्योंकि उनके पास जाति उन्मूलन की कोई परियोजना नहीं थी !!

परन्तु डॉ आंबेडकर ने जो जात -पात तोड़क मंडल 1936 में जो स्थापना दी थी उसी को लगभग दुहराते हुए , डॉ आंबेडकर को ख़ारिज करने की मनुवादी मानसिकता के खुर्रम खां बनना चाहते है ,उद्धरण निम्न है :---

'' 1) कोई भी व्यक्ति भारत के समाजवादियों द्वारा अपनाई गई इतिहास की आर्थिक व्याख्या के सिद्धांत पर प्रहार कर सकता है . किन्तु मैं यह स्वीकार करता हूँ कि इतिहास की आर्थिक व्याख्या इस समाजवादी दावे की वैद्धता के लिए आवश्यक नहीं है की सम्पति का समानीकरण ही एकमात्र वास्तविक सुधार है और इसे अन्य सभी बातों से वरीयता दी जानी चाहिए .फिर भी ,समाजवादियों से पूछना चाहता हूँ की क्या आप सामाजिक पहले सामाजिक व्यस्था में सुधार लाये बिना आर्थिक सुधार कर सकते है ? ''

2)अन्य बाते सामान रहने पर ,केवल एक बात जो किसी व्यक्ति को इस बात की कार्यवाही करने के लिए प्रेरित करेगी ,वह यह भावना है की दूसरा आदमी जिसके साथ वह काम कर रहा है ,वह समानता ,भाईचारा और इनसे भी बढ़कर न्याय की भावना से प्रेरित है .लोग जब तक यह नहीं जानेगे कि क्रांति के बाद उनके साथ समानता का व्यवहार होगा और जाति और नस्ल का कोई भेदभाव नहीं होगा ,तब तक वे सम्पति के समानीकरण में भागीदार नहीं होंगे ..क्रांति का नेतृत्व करनेवाले किसी समाजवादी का यह आश्वासन कि मैं जातिप्रथा में विश्वास नहीं करता ,मेरे विचार से काफी नहीं है .

3) तर्क के लिए मान लिया जाए की सौभाग्य से क्रांति हो जाती है और समाजवादी सत्ता में आ जाते है ,तो क्या उन्हें उन समस्यायों से निपटाना होगा ,जो भारत में प्रचलित विशेष समाज व्यस्था से उत्पन हुई है ? मैं नहीं समझता की उन पक्षपातों द्वारा उत्पन समस्यायों का सामना किये बिना ,जो जो भारतीय लोगो में उंच -नीच ,स्वच्छ -अस्वच्छ के भेदभाव पैदा करती है ,भारत में कोई सामाजिक राज्य एक सेकंड भी कार्य कर सकता है .

4) भारत में फैली सामाजिक व्यस्था ऐसा मामला है ,जिससे समाजवादी को निपटना होगा , .जब तक वह वैसा नहीं करेगा ,तब तक वह क्रांति नहीं ल सकता और सौभग्य से क्रांति लता है भी तो उसे अपने आदर्श को प्राप्त करने के लिए इस समस्या से जूझना होगा .मेरे विचार से यह एक ऐसा तथ्य है ,जो निर्विवाद है .यदि वह क्रांति से पहले जाति की समस्या पर ध्यान नहीं देता है ,तो उसे क्रांति के बाद उस पर ध्यान देना पड़ेगा ......आप जब इस दैत्य (जाति ) को नहीं मरोगे ,आप न कोई राजनीतिक सुधार कर सकते है ,न कोई आर्थिक सुधार . अब आप मार्क्सवादियों के उस होड़बोंग निष्कर्ष जिसमे जाती प्रथा को ख़त्म करने की बात करते है को देखिये ,जिसके बदौलत वो डॉ आंबेडकर को विफल बता रहे है -------

हाँ इतना तय है की सर्वहारा राज्य के स्थापना के बाद भी उत्पादन संबंधो के समाजवादी रूपांतरण और समाजवादी -सामाजिक -राजनीतिक -शैक्षणिक -संस्कृतक ढांचे के क्रमशः उच्चतर होते जाने के सुदीर्घ प्रक्रिया के साथ -साथ विचार और सांस्कृतिक धरातल पर भी सतत क्रांति की प्रक्रिया चलानी होगी --चंडीगड़ में अरविन्द स्मृति के ''जाति-प्रश्न और मार्क्सवाद '' के पेपर के पेज 1.

अब देखना होगा की 1936 के बाबासाहेब के कथनों को थोडा शाब्दिक हेर -फेर कर 2013 में ये मार्क्सवादी केवल दुहरा भर रहे है ,उसपर यह तुर्रा की डॉ आंबेडकर विफल थे ,इसे ही कहते की 89 साल में चले मात्र ढाई डेग . अब तो इनकी ब्राह्मणवादी मानसिकता की डॉ आंबेडकर असफल चिन्तक थे की पोल खुल गयी ?

मित्रों ! क्या आप बता सकते हैं कि भारत में रातों-रात क्रांति करने के दावे के साथ वजूद में आये संगठनों में एक खास साम्यता क्या है?नहीं आपको मानसिक कसरत से बचाते हुए मैं बताता हूँ.ऐसे संगठनों के साथ सबसे बड़ी साम्यता यह है कि वे सामाजिक मनोविज्ञान से दूर भागते हैं.चाहे 1920 से वजूद में आकर नरम-गरम असंख्य टुकड़ों में बंटे मार्क्सवादी संगठन हों या महात्मा गाँधी-जेपी  के अधुना अवतार हजारे-केजरीवाल के नेतृत्व में चला भ्रष्टाचार विरोधी संगठन आईएसी(इंडिया अगेंस्ट करप्शन),सभी के नेता और समर्थक बुद्धिजीवियों ने सामाजिक मनोविज्ञान की पूरी तरह अनदेखी की है.जिस देश के सर्वस्वहारा दैविक गुलाम(divine-slave)हों;जिस देश के शोषक, शोषण करना अपना दैविय अधिकार(divine right) मानते हों एवं जहां असंख्य समाजों में बंटे लोगों के परस्पर व्यवहार में घृणा एवं शत्रुता(hatred n enemity) की क्रियाशीलता हो वह भारत समाज पूरी तरह मानसिक –व्याधि से ग्रसित समाज है.इसकी मानसिक व्याधि के कारकों को समझे बिना रातो-रात क्रन्तिकारी बदलाव के सपने का जो हस्र होना चाहिए वह हुआ.भारत पृथ्वी की छाती पर एकमात्र ऐसा देश है जहां क्रांति सपना बनी हुई है.बहरहाल भारत में वर्षों से क्रांति का सपना देख-देख उद्भ्रान्त हो चुके मार्क्सवादी अभी भी क्रांति की उम्मीद नहीं छोड़े हैं.किन्तु यदि उनके सपनो का महल आकार लेता है तो उसकी बुनियाद गणतांत्रिक-व्यवस्था के ध्वंस पर ही खड़ी होगी.मान लिया जाय उनका संघर्ष सफल होता है तो ज़ाहिर है भारत में भी रूस,चीन,चेकोस्लाविया इत्यादि  की भांति ही तानाशाही सत्ता कायम होगी.वह तानाशाही मानसिक व्याधि- ग्रस्त भारतीय समाज के लिए कितनी उपयोगी हो सकती है,उसका कयास लगाने के प्रयास से ही जुडी है आज की मेरी शंकाएं.          

वैसे तो तानाशाही किसी भी देश के लिए सुखकर नहीं साबित हो सकती .किन्तु प्रयोजनवश इसका प्रयोग उन देशों में हो सकता है जिनका स्वरूप श्रेणी-समाजों जैसा है,जहाँ भारत जैसी जाति व्यवस्था नहीं है.इसका अच्छा परिणाम रूस और चीन जैसे देशों में सामने आया है. श्रेणी समाजों के छोटे-बड़े हिटलर,चाउसेस्कू,गद्दाफी तमाम कमियों के बावजूद एक विशेष गुण से समृद्ध होने कारण राष्ट्रहित में बेहतर परिणाम दे सके.वह विशेष गुण यह है कि वहां के लोग काफी हद तक 'समग्र-वर्ग की चेतना' से लैस  रहे.लेकिन भारत जैसे देश में किसी भी किस्म की संस्था में व्यक्तिविशेष के हाथ शक्ति का संकेन्द्रण घातक  हो सकता है.कारण भारत के जाति समाज में 'समग्र-वर्ग की चेतना' से लैस  व्यक्ति का उदय असंभव है..यहाँ व्यक्ति की  सोच स्व-जाति/वर्ण  के स्वार्थ की सरिता के मध्य प्रवाहित होती रहती है.यहाँ महान से महान  व्यक्ति निज हित से ऊपर उठने पर सबसे पहले सजाति-हित की चिंता करता है.इससे ऊपर उठने पर अधिक से अधिक स्व-वर्ण की बात सोचेगा.इससे आगे जाते –जाते उसकी परहित सोच दम तोड़ देती है .स्व-जाति/वर्ण की इस मानसिक-व्याधि से उबरने का दृष्टान्त आजतक इस देश का बड़ा से बड़ा समाज सुधारक-नेता ,साधु-संत,लेखक-कलाकार तक स्थापित नहीं कर पाया है .यही कारण है सवर्ण समाज में जन्मी सूर-तुलसी,राजा राममोहन-विद्यासागर-दयानंद सरस्वती ,रवि-बंकिम,सत्यजित-विमल राय जैसी विरल प्रतिभायें तक बहुजन समाज को उपकृत करने में व्यर्थ रहीं.ऐसा नहीं कि जाति समाज की इस चिरपरिचित दुर्बलता से बहुजन नायक मुक्त रहे.इस कारण ही आंबेडकर जैसे भारत के सर्वकाल के सर्वश्रेष्ठ मनीषी बहुतों द्वारा महारों के नेता कहलाने के लिए अभिशप्त हुए.आज मायावती,मुलायम-लालू,पासवान जैसे नेता अपनी चमत्कारिक उपस्थिति दर्ज कराने के बावजूद  क्रमशः गैर-चर्मकार,गैर-यादव और गैर-दुसाधों का यथेष्ट सम्मान जीतने में काफी हद तक व्यर्थ हैं.लेकिन निंदकों से परे हटकर यदि हम यह मान लें कि बाबासाहेब,फुले,पेरियार,कांशीराम जैसे श्रेष्ठ बहुजन नायक या आज के माया-मुलायम,लालू-पासवान जाति की सीमाओं से मुक्त रहे या हैं तो भी क्या हम इस बात से इनकार कर सकते हैं कि इनकी प्रतिभा से उपकृत सिर्फ बहुजन समाज हुआ है,शेष अल्पजन नहीं.इसका मतलब यह हुआ कि भारत की अपवाद मानी जानेवाली प्रतिभाएं तक समग्र-वर्ग की चेतना से समृद्ध नहीं रहीं.  

मित्रों दुसाध का दावा है कि भारत के जाति समाज में आज तक एक भी ऐसा व्यक्ति भूमिष्ठ नहीं हुआ जो समग्र वर्ग की चेतना से संपन्न हो .विनम्रता से कहूँ कि समाज मनोविज्ञान से जुड़ा मेरा यह रह्स्योद्घाटन मार्क्स के वैज्ञानिक चिंतन से कई सौ प्रतिशत ज्यादा वैज्ञानिक है .अभी परसों मैं महात्मा गाँधी और पेरियार से जुड़ा जो वार्तलाप पोस्ट किया था उसमें  आपने देखा होगा गाँधी ने एक अच्छे ब्राह्मण का नाम बताकर पेरियार को तो चौका दिया था .पर,मेरा दृढ विश्वास है कि आप दुसाध को नहीं चौका पाएंगे क्योंकि,साहित्य,राजनीति,फिल्म ,कला इत्यादि किसी भी क्षेत्र में आज तक ऐसा कोई व्यक्ति पैदा ही नहीं हुआ जो ब्राह्मण, क्षत्रिय,वैश्य और शुद्रातिशुद्र इत्यादि सबको समान रूप से देखे.भारत समाज सुधर के जनक राजा राममोहन राय और विद्यासागर का सबसे बड़ा अवदान क्रमशः सती और विधवा प्रथा का उन्मूलन था.ये समस्याएं सवर्ण विशेषकर उन दोनों महमानोवों के स्व-जाजति की समस्याएं थी.आज़ाद भारत में पंडित नेहरु,इंदिरा गाँधी,जेपी,ज्योति बासु जैसे राजनीति के सुपर स्टार पैदा हुए पर,माओवादियों को जगह देने के लिए इसलिए अभिशप्त हुए कि समग्र वर्ग की चेतना के अभाववश वे वर्ण-व्यवस्था के वंचितों की स्थिति में इच्छित बदलाव न ला सके.आज सुर-तुलसी-मीरा से लेकर बंकिम –शरत-प्रेमचंद बहुजनों द्वारा इसलिए खारिज हो चुके हैं क्योंकि वे स्व-जाति स्वार्थ के चलते बहुजन हित का चिंतन न कर सके.मैं लेखक जैसा भी व्यक्ति बहुत अच्छा हूँ,ऐसा दावा मेरे संसर्ग में आनेवाले सभी करते हैं.किन्तु तमाम मानवीय गुणों के बावजूद 50 किताबों के लेखक दुसाध की सारी प्रतिभा सर्वजन नहीं,बहुजन के हित में इसलिए इस्तेमाल हो रही है,क्योंकि दुसाध भी समग्र वर्ग की चेतना का कंगाल है.भारतीय समाज की इस व्याधि को देखते हुए मैं सोनिया गांधी से कुछ इसलिए उम्मीद रखता हूँ क्योंकि उनका जन्म एक जाति- मुक्त समाज में हुआ है .जब उन्होंने प्रधानमंत्री का पद ठुकरा दिया था,तब मैंने बहुत भारी मन से लिखा था-'समग्र वर्ग की चेतना संपन्न प्रधानमंत्री से वंचित देश'.

मित्रों उपरोक्त पंक्तियों में हिंदुओं की मानसिक व्याधि  का जिक्र करते हुए मैंने दावा किया है कि मेरा यह चिंतन  मार्क्स के वैज्ञानिक चिंतन से कई सौ गुना वैज्ञानिक है.जानते हैं इस दावे का स्रोत क्या है? बाबासाहेब आंबेडकर का सामाजिक चिंतन.हिंदुओं की चेतना से जुड़े विचार के प्रणेता डॉ.आंबेडकर हैं.उन्होने ही समाज विज्ञान के अध्ययन की दुनिया में मील का पत्थर बनी अपनी रचना 'जाति के उच्छेद' में कहा है -'हिंदुओं में उस चेतना का सर्वथा अभाव है जिसे समाज विज्ञानी समग्र वर्ग की चेतना कहते हैं.उनकी चेतना समग्र वर्ग से सम्बंधित नहीं है.हरेक हिंदू में जो चेतना पाई जाती है ,वह उसकी अपनी जाति के बारे में होती है.जब भी कोई समुदाय अपने स्वार्थ से प्रेरित होता है,उसमे असामाजिकता की भावना पैदा हो जाती है.यह असामाजिकता की भावना अर्थात अपने स्वार्थ रक्षा की भावना विभिन्न जातियों  के एक दूसरे से अलग होने का ऐसा ही एक विशिष्ट लक्षण,है जैसा की अलग-अलग राष्ट्रों का.ब्राह्मणों का मुख्य उद्देश्य है कि गैर-ब्राह्मणों के विरुद्ध अपने स्वार्थ की रक्षा करें और गैर-ब्राह्मणों का मुख्य उद्देश्य यह है कि ब्राह्मणों के विरुद्ध अपने स्वार्थ की  रक्षा करें.इसलिए  हिंदू समुदाय विभिन्न जातियों का संग्रह मात्र नहीं,बल्कि वह शत्रुओं का समुदाय है.उसका हर विरोधी वर्ग स्वयं अपने लिए और अपने समुदाय के लिए जीना चाहता है.'    

मित्रों,हिंदुओं की इस विशेष मानसिक –व्याधि से आपको अवगत कराने के पीछे जो उद्योग  लिया हूँ उसका खास कारण यह है कि 93 वर्ष से मार्क्सवादी भारत में क्रांति करने का जो प्रयास कर रहे हैं,हो सकता है लाल झंडे का भाग्योदय हो और उसे लाल किले पर हम फहराते हुए देखें.अगर वह दिन आता है तो वह शासन प्रणाली भारत से विलुप्त हो जायेगी,जिसके तहत जनता के वोट से चुनकर जनप्रतिनिधि सत्ता में आते हैं.कारण,तब भारत में सर्वहारा की तानाशाही कायम हो जायेगी.चूँकि नरम-गरम  तमाम मार्क्सवादी दल ही ब्राह्मणों की गिरफ्त में हैं इसलिए वह तानाशाही,दरअसल ब्राह्मणों की ही तानाशाही होगी.ऐसे में आपके समक्ष मेरी शंका है-

1-जिस देश में बड़े-बड़े साधु-संत,राजा-महाराजा से लेकर राजा राममोहन –विद्यासागर,दयानंद-विवेकानंद जैसे समाज सुधारक;सुर-तुलसी,बंकिम-रवि-प्रेमचंद जैसे साहित्यकार और पंडित नेहरु-इदिरा गांधी-वाजपेयी -जेपी-ज्योति बासु जैसे उच्च वर्णीय,खासकर ब्राह्मण नेता समग्र वर्ग की चेतना से कंगाल रहे वहां आज की तारीख में सक्रिय भद्र से भद्र ब्राह्मण-सवर्ण मार्क्सवादी के हाथ में सत्ता  की बागडोर जाने पर क्या वह ओबीसी-एससी/एसटी और अल्प संख्यकों के भी हितों की समान रूप से रक्षा कर पायेगा?

2-जिस देश में एक-एक समुदाय, एक –एक विरोधी राष्ट्र की भूमिका में दण्डायमान हों ;जहां ब्राह्मण,गैर-ब्राह्मणों और गैर-ब्राह्मण,ब्राह्मणों के विरुद्ध अपनी स्वार्थ रक्षा में सदैव तत्पर  हों, वहां सर्वहारा की तानाशाही क्या परस्पर शत्रुता से लबरेज विभिन्न सामाजिक समूहों की स्वार्थ रक्षा के लिए उपयुक्त हो सकती है?  

3-क्या आप विश्वास करेंगे कि सवर्णों द्वारा परिचालित क्रन्तिकारी संगठन सोशल साइक्लोजी की इसलिए अनदेखी करते हैं क्योंकि इससे बहस के केन्द्र में जाति आ जायेगी और जाति के केन्द्र में आने पर उनके मंसूबों पर पानी फिर जायेगा?

मित्रों ,कल मैंने वादा किया था कि आज शंकाओं का ज्यादा बोझ आप पर नहीं डालूंगा.अपने वादे पर कायम रहते हुये आज नाम मात्र की शंकाओं के साथ आपसे विदा लेता हूँ.कल फिर कुछ शंकाओं के मिलूँगा.

Expectedly, the high-pitched media-supported Anna anshan at the Ramlila Ground has come to an end with Parliament passing a unanimous resolution as dictated by Team Anna. The three conditions—that the lower bureaucracy should be within the Lokpal's ambit, Lokayuktas in States should be brought in through a Central legislation like the Lokpal's, and a citizen's charter detailing the responsibilities of government functionaries and the penalty for non-fulfilment should be instituted—were favourably discussed by Parliament but the government initially avoided passing the resolution, retracting its commitment to Team Anna and thus adding one more point to its score of foolishness. Soon thereafter, it retracted again and managed a unanimous resolution in Parliament, which would satisfy Anna Hazare to give up his fast on the 12th day. The media screamed "Anna wins full victory" while Hazare himself cautioned the ecstatic crowds that it was just a half-victory. He announced that he had suspended his fast; his agitation would continue until the Lokpal Bill was passed.

Although the media is still fraught with the Anna euphoria in the absence of some other 'breaking news', it is cooling-off on the episode and coming to terms with the fact that it is a long circuitous way to go for getting the Bill passed. In the process ahead whether the Lokpal Bill would really conform to the Jan Lokpal draft, is anybody's guess. While Parliament's commitment to the three conditions is of 'moral' nature, in the situational context it may be reasonably relied upon. However, since it is linked to the architecture suggested by the Jan Lokpal Bill, it is necessary the final Bill conforms to the latter. As of now there are already nine alternate drafts of the Lokpal Bill, and by the time the Standing Committee considers them, there shall be many more. They will all be considered by the Standing Committee. In all probability, the final Bill that will be put before the House would significantly differ from the Jan Lokpal Bill, architecturally as well as in contents. Will the entire episode then be repeated once more, after months? Going by Hazare's resolve, the answer is yes; but will that not be dangerous?

Emboldened by the nationwide support he received, he has already announced his next step to take up electoral reforms in demanding inclusion of an option of 'none-of-the-candidates' to exert pressure on the system to have 'good' people in governance. There is no doubt that he would be hugely supported by the burgeoning middle classes in all his moves, now that they saw in him a second Gandhi. But the point is to ponder whether all these legislative reforms will really arrest the craving for accumulation in the dominant classes, legitimised by the neoliberal ethos; which class interests are driving them; and in what way they will serve those interests.

Government's Game Plan

THE government's flip-flops, nay, the series of blunders, has surely facilitated the movement. After tasting success in its high-handed demolition of the Baba Ramdev show at the Ramlila Ground, the government could use force against the crowds that showed up in support of Anna Hazare and possibly demolished it. But it did not do so. If one takes a cursory look at its behaviour right from the beginning of this movement, one could sense an astounding ineptitude of the government in handling it. To start with, it should not have driven Hazare to go on fast. Within hours of sitting on fast, the government began discussing with his team and made a volte-face on its foolish plea that drafting the Bill was the government's prerogative, in making it a part of the joint drafting committee. If it was to be the joint drafting committee, it could have involved representatives of all political parties and pre-empted future hurdles in the process. Not only that it did not do it, but also it made another somersault by rudely abandoning the exercise, discarding the Jan Lokpal draft under discussion and forwarded its absurdly drafted Bill to the Standing Committee.

When Hazare declared his second spell of fast, the government could easily guess what was in store for it and plan its move in advance. But surprisingly, it became further ludicrous. The Delhi Police, which is controlled by the Central Government, putting unreasonable conditions for the agitators; arresting Hazare and then releasing him, both without any plausible reason; preparing the Ramlila Ground as the venue for his fast; and letting the people's frenzy all over the country reach its zenith over 10 long days, is certainly unbecoming of the government of such a large country. It was too foolish for the government to do so. But was it just foolish as it is seen by most people? It was not an isolated act or acts but a long series of foolish actions, which should prompt suspicion of some game- plan of the government. After all, could the experienced politicians like Pranab Mukherjee, Salman Khurshid, or even Kapil Sibal and Chidambaram, who may appear brash but are certainly not brainless, be so foolish collectively to let it happen? And that too under the leadership of our Oxford-Cambridge educated Prime Minister? It appears unlikely.

With hindsight though one can see this series of apparently foolish actions of the government has only served one purpose: allowing long enough time to build up hysteria all over the country against the political class and government. How could the political class or government scheme against themselves? What could be its possible utility to them? What possible purpose could it serve? One may guess, it serves a definite purpose of the government in building a strong public opinion in the country against the government and the political class dabbling in matters of economy, and therefore, in corollary, in favour of free-market reforms. The uncongenial context of the series of scams, untamed inflation, rising people's movements against various kinds of land grabs, growing unemployment, and so on were exposing the anti-people character of the pro-elite neoliberal policies of the government. The government badly needed a strong voice from among the people that could overcome this anger of the masses and pave the way for further reforms for which the neoliberal Team Manmohan has been craving.

The Anna movement actually has come as a blessing in disguise for the government to accomplish this. Do not make any mistake, the Lokpal is nothing but essentially a regulator which is prescribed by the neoliberal framework to ensure that the free market operates by certain guidelines. This regulator could be conceived to regulate the political and bureaucrat market so as to keep it attuned to the process of deepening neoliberal reforms. As such Manmohan Singh is not averse to the idea of a Lokpal; he would genuinely want it. It is not because he is concerned about corruption; rather, he is not at all. People were bewildered at his silence when scam after scam unfolded and stunned the country. They do not know that for a hardcore neoliberal, corruption is not an issue at all. It is the grease that lubricates the economic growth machine. After all, it is a part of the market mechanism. If people paid some bribe to get 2G licences and caused the 'notional' loss to the exchequer of Rs 176,000 crores, it was the perceived price the licensees were prepared to pay for the 2G spectrum in the existing market.

The monumental ineptitude exhibited by the government may only be understood by this possible game-plan. The longer the frenzy over the Lokpal lasts, the better it is to create and deepen the resentment against the politically driven staus quo and pave the way for the market driven reforms. The government is only worried about creating any structure that would impede these reforms and would surely ensure its will prevails even in the face of euphoric demands. It is not really worried or scared of the Lokpal, because it very well knows that that will just be another wheel for its applecart, which will not change its direction. It is only worried that it should not slow it down.

BJP the Net Gainer

THE beauty of India's parliamentary system is that there is essential similarity between all ruling class parties on most core policy matters and behaviours, whether it is economic reforms or foreign policy or secularism and communalism. They differ at the most in shade. In class terms it may thus be called political oligopoly. They would, however, fight against each other to the hilt to capture power. In the current contention between the 'civil society' and the government, the BJP sensed a great opportunity to embarrass the Congress-led UPA and score political points. The pathetic performance of the UPA-II has enlivened its hopes of winning the next elections. On corruption, however, it was not in a position to come clear because of the fear of skeletons tumbling out from its own cupboards, notwithstanding its apologetic defences. It was amusing to watch the TV debates in the wake of this Lokpal imbroglio with the Congress and BJP spokesmen hurling accusations at each other. That rather truly reflected the state of the nation, where corruption is no more an absolute evil but a relative measure. Other regional parties also having tasted meat in some form or other, did not fare any better.

The BJP used every opportunity skilfully in the debate over the Lokpal drafts to embarrass the government, without opening its cards. When Anna Hazare came out on the road, it actively supported him. During his fasts at Jantar Mantar, Raj Ghat and lastly Ramlila, its progenitor, the Sangh Parivar, took an active part in mobilising people. Many people had commented upon its imprint in the picture of Bharat-mata in the form of a Hindu goddess that constituted the backdrop at the Jantar Mantar, strikingly similar to the one used by the Sangh Parivar in their programmes. Although the organisers belonging to India against Corruption might have had Hindutva proclivities (and some people did accuse a few individuals of that) that led them to put up the Bharat mata there, Team Anna by then had incorporated progressive people like Prashant Bhushan, whose secular credentials could not be suspect. The fact that the comments emerged from outsiders and not from the motley crowd is also significant in understanding the character of the crowd. The slogans of Vande Mataram, Bharat Mata ki Jai and many others reflected the influence of the Sangh Parivar on the crowd.

Although they carried on with their apologetic explanation that the picture of the goddess put up on the stage was actually of mother India and not that of the Hindu goddess, the organisers were embarrassed enough to change it to the picture of Gandhi at the Ramlila Ground. The government's mishandling came handy for the BJP to embarrass the government. The commen-tators, sans touch with the ground reality, did not see the Anna movement being actively driven by the Sangh Parivar but with every BJP person speaking in unison of her/his support to the movement halfway through testifies to this truth. At many places people have noted the Sangh pracharaks actively mobilising people to participate in their processions and demons-trations. Ashok Singhal of the VHP proudly claimed that they had provided free food to the people gathered at the Ramlila Ground. Insofar as the BJP aimed at embarrassing the government, it accomplished it in full measure. Both ways, in terms of preparing the general public opinion in favour of further neoliberal reforms as the government perhaps wanted, and in the process causing embarrassment to the government, the BJP was the gainer.

Alienation of Masses

WHILE the crowds surged with every passing day in support of Anna, it was mainly drawn from the middle class segment of the population, which could be described as urbane, English- educated, upper-caste, upwardly mobile young people. The frontal organisations of the Sangh Parivar also significantly contributed to the swelling crowd. This is the neoliberal generation of India, most of them having grown up during the last two decades, seeing the Indian economy growing at an impressive rate. They do not share the shame and apology for India that their elders had because of her so-called Hindu rate of growth which refused to transcend the 3.5 per cent marker and visible poverty. The times this generation lived through was marked by the 'licence-permit raj', domination of the public sector, rise of the backward castes, and cultural build-up of the lowest strata of Dalits. Although the government policy had systematically been driven towards capitalist development without in anyway denting the feudal classes, and in the interests of bourgeoisie, the Nehruvian rhetoric had succeeded in creating an impression that it was pursuing a socialist path. During the Cold War period, its association with the USSR and consequent annoyance of the US camp also strengthened this impression. The Nehruvian project did aspire to see India emerge as a modern nation shunning its decadent traditions and customs. People tended to intellectually believe that India needed to change its belief-system and culture, and carried a sense of apology for the past. Although it did not make much dent to the practice, nobody, except the hardline Hindu, could dare to justify the caste system, communalism, religious rituals, gods and godmen in public.

The neoliberal era began informally with Indira Gandhi taking the then biggest loan from the IMF of $ 5 billion immediately after her second coming, that was soon identified with Rajiv Gandhi after her assassination, and formally in July 1991 under the Narasimha Rao Government which brought in a systematic reversal in the previous trend. The 'free-market' propaganda of the global capital appeared sensible in rescuing the world economy in crisis, which was associated with the statist blockade. The decline of the socialist regimes also boosted the belief. The Indian economy generally began looking up with visible markers of 'development' like foreign brands being freely available in the Indian market, foreign models of cars appearing on roads. The reversal of the economic trend created reversal of the apologetic thinking of India. India's emergence as a major player in the IT sector, Indian professionals in the US gaining prominence, whether as a cause or consequence, rather enhanced the pride in 'India'. The young people generally blamed their parents' generation and the ideological baggage of socialism for the recent past and believed in the intrinsic superiority of India, along with all its customs, tradition and belief-system. Caste, communalism, religious rituals, culture and tradition, which were being apologetically spoken about, began to be openly justified in public. This reversal overlapped with the Hindutva ideology. This has been one of the major factors behind the BJP's rise from oblivion to political power in the 1990s.

These policies being inherently elitist, they helped the typical upper-caste, English and technical educated youth of cities and towns in constituting a rising middle class. It imagined India as an emerging superpower and in its superficial ways identified political and bureaucratic corruption, the overall system of governance, and perhaps the Constitution that dampened 'meritocracy' as hurdles in its path. The huge support that the Jan Lokpal campaign received from this segment could be understood in this manner. While they would like freeing India from these evils, this segment, true to its class character, cannot stomach the idea of thorough overhaul of the system, a la a revolution that, say, the Maoists want to bring about. The Maoists also speak in the name of the people, the vast majority of the toiling people who are rendered invisible by the neoliberal onslaught. The social engineering, non-violence, civil society, people's power are the typical wordy armour of this class which tend to exclude those who are not part of them. It is natural that the lower strata, certainly the Dalits, Adivasis, minorities and artisan castes untied to the dominant castes, do not identify with their show and rather would oppose it even in an aberrant manner.

It is not that they favour the current governance or like corruption. Being the biggest victims of these evils, they would rather want them to be rooted out. But they do see the campaign being driven with class interests inimical to theirs and not particularly aimed at eradication of these evils. The legislation of Acts has been a veritable means to pacify them at various times. Take, for instance, the enactment of the Atrocity Act, which aimed at curbing the incidence of caste atrocities against SCs and STs. What is the reality? Since its enactment, the caste atrocities have rather consistently risen. Take another case of the much acclaimed Right to Education Act. This Act in reality has taken away the inherent constitutional right of the poor children to get education in common schools and rather legitimised the multi-layered education system that was introduced under the neoliberal ethos. The result of it will be soon seen in the huge disempowerment of the entire rural people in general and the SCs and STs in particular. The crowds at Ramlila thought (indeed it is reported as such in a section of the press) that these 'undeserving' people do not have brains. They shouted provocative slogans and held placards that reservations were the root cause of all corruption. Some of their key leaders were reported to have been associated with the anti-reservation campaigns. An editor of one Hindi periodical, 'Diamond India', Bhanwar Meghawanshi has listed many such provocations in his article 'Why Are Dalits Not Enthusiastic About Anna's Movement?' Provocation apart, there has not been any remote reference to the caste culture which could be easily discerned as the mother of moral corruption or the neoliberal policies of the government which can be directly linked to the kind of corruption that provoked the campaign. The complete tone and tenor of the campaign was slanted against the lower strata of the society which, though invisible on TV channels, constitute the vast majority of this country. Team Anna wanted to dispel this impression in a symbolical manner, again ironically borrowed from the Sangh Parivar's repertoire, by being offered coconut water to break his fast through two girls, one a Dalit and the other a Muslim. It needed to know that alienation of these communities has gone a little deeper to be dispelled by such a stereotypical symbolism.

Lokpal as a Saviour

NOBODY can oppose the need to strengthen the mechanism to curb corruption in the country. But to believe that something like the new oligarchic set-up of Lokpal will do the magic, just because it worked in Scandinavia and other such countries, is unjustified. Most Acts in most countries are essentially similar but the result they produce is drastically different. It has to do with the cultural paradigm in which they work. There is a case to take cognisance of these issues at this stage. Corruption can be seen as the outcome of the power asymmetry in society; unlike other societies it appears qualitatively endemic to our caste culture with its rigid hierarchies. This culture has produced the doublespeak of the elite, expressing altruistic concern for the people but at the same time continuing with their exploitation. It is an integral part of our culture that distinguishes us as arguably the most corrupt people in the world. India's corruption ranking by Transparency International also does not catch this reality. The African countries that appear more corrupt than us by those ranks were also basically taught corruption by the Indian migrants. The Swiss Banking Association report of 2008 had indicated (mysteriously it is not being mentioned anymore these days) a whooping $ 1891 billion of Indian black money deposits in the Swiss bank, more than all the black money deposits of all countries in the world. This perhaps best portrays our character. The remedy therefore becomes eradicating socio-economic inequality from the society. The Lokpal prescription does not reflect this diagnosis of the disease and instead focuses on the mere symptom.

Anna and his team believe that 50-60 per cent of corruption can be eliminated if their Lokpal is installed. The entire premise of the campaign is on creating an independent and incorruptible agency, which will curb corruption from the entire political class and bureaucracy. Theoreti-cally speaking, constitution of such an agency itself is next to impossible because in our culture those in public prominence, from amongst whom such a selection would be made, cannot be conceived to be beyond corruption; the honest and sincere people having been thrown out of the arena. Paradoxically, they may be found in Indian jails charged under the Sedition Act. Many people have raised genuine issues in regard to its practicability and efficacy and they cannot be just ignored. The Lokpal or Jan Lokpal will be one more oligarchic institution to be borne by the toiling masses of this country. Take, for example, any of the recent scams and ask a simple question: would the Lokpal have really deterred these scamsters? Would this Bill have prevented the CWG scam, the NTRO scam, the CVC appointment or any of the recent embarra-ssments? Only the incorrigible optimist might answer the question in the affirmative.

The kind of corruption Team Anna speaks about also has its identifiable source but it scrupulously avoided speaking about it. The Global Financial Integrity (GFI) study titled "The drivers and dynamics of illicit financial flows from India: 1948-2008" by economist Dev Kar estimates that out of $ 462 billion siphoned out of India during the last 61-year period, 68 per cent is attributable to the post-reform period of just 18 years. There are many such country studies and acknowledgement from the prota-gonists of neoliberalism itself that confirm that neoliberal policies have caused the new genre of corruption. Instead of pointing at this source, the Lokpal campaign rather effectively diverted the people's attention from it. Let Anna undertake fast unto death for stopping the economic reforms of the government in order to curb corruption and then see how many people come to Ramlila and what way the state reacts! Instead of identifying the prevailing structure and system as the source of corruption, the campaign is focusing on individuals, forgetting the funda-mental dictum that individual behaviour is largely of the situation and less of the self. This country has been after saviours for far too long. We had many saviours; every caste and community has its own. The middle classes found their saviour in Anna Hazare to cleanse this country of evils. They propose the saviour in the Lokpal. Saviours have come and gone; the only thing that they did was to damage the consciousness of the people that it is they who are the harbingers of change.

Conclusion

ANNA HAZARE, a simple old man, that benevolent chieftain of sorts from a remote village, who has earned a certain reputation by pursuing causes that he believed in steadfastly, has come up at the national level as a miracle man through this movement. But the credit for the miracle halfway through must go to the media that worked relentlessly to build up and project his image. The media, which easily adopts a holier than thou kind of attitude, can itself be marked for corruption in its omissions and commissions. That it is a business, pure and simple, conducted with certain business strategy is a settled question. Even in earlier times, notwithstanding its pretentions to responsibility and ethics, it was a business. But then the business strategy had a dimension called the 'long term' which impelled the media to establish its credibility and ethical image, ignoring the lures of the short term. Now, the product life-cycles have become so small that this long term has almost disappeared from the strategy consideration and the short term has overtaken everything. The media therefore unabashedly seeks revenue maximisation through TRP and for that goes to any extent manufacturing news. Taking its social consequences, this very process itself can be condemned as corruption. But who will say this to whom when the media controls the entire communication in our age? The enormous power the media wields can easily create miracles of the kind out of practically anything, if it finds the potential to serve its own interests.

As discussed above, this movement has steered clear of the root causes of the disease of corruption and pitched its prescriptions around corruption as a symptom. It is also indicated that if it had done the former, it would have never got the kind of support it received. Such simplistic and superficial diagnosis of social matters is characteristic of the neoliberal ideology and fits well with the class character of the middle classes who like just a patch-work solution that can bring them incremental benefits while preserving what they already have. Instinctively they are scared of going to the roots of the problem because that would demand a radical overhaul of the system which could threaten their own possession. Taking the aspirations and frustrations of this class, this movement had just the right mix to attract it. Their perception of corruption is constricted; it is limited to the politicians and bureaucracy. They would not, even by mistake, touch the corporations and businessmen who are the main feeders, the fountainhead of this corruption. They would not similarly touch NGOs of various hues that are conduits of the neoliberal ideology and yes, the media.

The greatest success of the movement lies in galvanising the neoliberal middle class, which generally remained apathetic to politics, to make a statement on the road. They have effectively created an illusion that the system could be 'revolutionised' by introducing legislative reforms like the Lokpal and changes in the election system or bringing in 'good' people in place of bad ones. They attempt to thwart the possibility of revolt which the situation is fast driving people to. The campaign has already prevented people from seeing the real rot in the system; the nature of the disease and diverted their attention to the symptom. Many people called it a revolution, not knowing what stuff revolutions are made of. Well, if it qualifies to be a revolution, we may as well have to call it a neoliberal revolution!

Criminalising People's Protests

 

The manner in which Irom Sharmila's demand for the repeal of the draconian Armed Forces (Special Powers) Act has been handled by the Indian state is indicative of its intent to further narrow the scope for democratic protest, even opposition that is centred on the right to life itself. With such actions, the state is subtly communicating to the people that there is no democratic option left in the country.

Public protests signify that democracy is alive and well. Whatever its form, the essence of democracy is the space it provides for people to voice their protest against the government. However, while India has managed to flaunt for decades that it is the world's largest functional democracy, it has systematically decimated such space for the masses. Today, this space has been symbolically reduced to small designated pockets in every state capital where aggrieved people can gather and shout to their hearts' content only so that they can hear themselves. Not much unlike jails, with their barbed wire fences and narrow openings guarded by a thick posse of armed policemen, the authorities do not let public protest infect the people at large. The maximum the people protesting at these places can reach is the police sub-inspector seated there to receive their memorandums. Indian democracy has not, however, been content with this general strangulation of democratic space; it often takes offensive against the protesters by slapping criminal charges on them. Examples are legion but the recent proceedings against Irom Sharmila, the iron lady of Manipur, who was brought to Delhi to face trial for her "crime of attempting suicide" at the Jantar Mantar best highlights this trend.

Sharmila's Crime

Sharmila's protest began with her indefinite fast on 3 November 2000, a day after 10 persons were shot down by the Assam Rifles, one of the Indian paramilitary forces operating in Manipur, while waiting at a bus stop just outside Imphal. The incident later came to be known as the "Malom Massacre". Within days, Sharmila was taken by the police, and since then, she is being force-fed a liquid concoction of nutrients in a hospital, which serves as her prison. After every year in detention, she is released for a day and rearrested for attempting to commit suicide, because she refuses to call off her fast until the government repeals the Armed Forces (Special Powers) Act, 1958 (AFSPA), which is in force in Manipur, Assam, Nagaland and parts of Arunachal Pradesh besides, Jammu and Kashmir. Now in its 13th year, her protest is the longest hunger strike in recorded history, which has shaken the entire world but failed to sensitise the Indian rulers. On the contrary, they chose to actuate their penal machine and charged her with an "attempt to commit suicide", which is unlawful under Section 309 of the Indian Penal Code.

The AFSPA against which Sharmila reiterated her protest to the metropolitan magistrate, Delhi however continues on the statute. This draconian Act that giving the army the unquestionable powers to shoot to kill, arrest and search or even destroy property on mere suspicion and enacted as a short-term measure to allow the deployment of the army in India's north-eastern Naga Hills, has been in existence for over five decades. According to a report entitled "Manipur: Memorandum on Extrajudicial Summary or Arbitrary Executions" by the Civil Society Coalition on Human Rights in Manipur and the United Nations, altogether 1,528 people, including 31 women and 98 children were killed in fake encounters by the security forces in Manipur alone between 1979 and May 2012. Of these, 419 were killed by the Assam Rifles, while 481 were killed by combined teams of Manipur Police and the central security forces. These are gory statistics but they do not tell the human tragedy that befell entire generations that grew up under the shadow of the gun. It is a usual sight in Manipur to find even school kids sitting in protest against the atrocities by the armed forces.

Logic of the State

The government cites the ongoing insurgency in the hilly state to explain its stand against the repeal of AFSPA. According to its argument, nearly 15 militant outfits are active in the state and in the period between 2007 and 2011, over 1,500 people were killed in militancy-related violence, among them were 1,011 militants and 406 civilians. This argument itself should prompt a simple question, if the army, with a free hand, has not been able to control the so-called insurgency over five decades, what is the justification for the Act? It may even be argued that the insurgency, given the government's own statistics, has increased during the currency of the Act. This is because the excesses committed by the armed forces with impunity alienate people and impel them to take up the gun. If one dispassionately looks at the north-eastern states, comprising about 7% of India's total area and 3.7% of its population, bigger than many countries but devoid of any notable development, one cannot but get a feel that they are like a colony governed by the armed might of India. The Constitution does provide for emergency clauses but they are meant to be short-lived. The arguments the government and its army establishment proffer for continuing with AFSPA are, interestingly, the same as the arguments advanced when the 1942 ordinance was enacted in order to keep the British Empire intact.

The same logic extends to the protesting people in mainland India. There are scores of draconian laws like the Unlawful Activities (Prevention) Act (UAPA), the Chhattisgarh Special Public Security Act, the National Security Act, and various provisions in the penal code, like "sedition", which continue to mock at our claim of being a democracy. Given the increasing divide between the majority of people mired in abominable poverty and powerlessness and a miniscule minority with all the pelf and power, people's protests are a natural outcome. During the initial decades of post-Independence India, when the ruling classes had not yet consolidated themselves, these protests were responded to by the state with colonial decency. But by the mid-1970s, an oppressive Emergency was declared, and after a spell of political turmoil, the country entered the neo-liberal era that ideologically trashed social protests and legitimated the oppressive social Darwinist ethos of the rulers. The enforcement of the Terrorist and Disruptive Activities (Prevention) Act (TADA) in 1985 succeeded by the Prevention of Terrorism Act (POTA) in 2002 and thereafter UAPA in 2004 during this era, duly aided by global "security syndrome" unleashed by 9/11, should be seen in that light.

The much-maligned Maoist movement is essentially a public protest, notwithstanding its mode of expression, as acknowledged by the government occasionally, but the latter has chosen to criminalise it, calling it "the biggest internal security threat" and waging a full-fledged war against it. Today, it has begun to do the same to civil rights activists, trashing them as Maoist supporters. These activists along with many legal luminaries have been cautioning that the ordinary laws if operated equitably are capable of tackling any kind of criminal activity. The extraordinary laws with draconian provisions create a false notion of security but there is no empirical evidence that they really work. Invariably, they have operated as oppressive tools against innocent people and thereby aggravated the very problem which they were supposed to solve. It is the perceived injustice of the state that impels people to extremity. The paranoia of the ruling classes is proving myopic in ignoring the grave consequences to democracy.

Grave Consequences

The saga of Irom Sharmila and the Manipuri people struggling against AFSPA will surely leave an indelible mark on our democratic credentials. What could be a more intense protest by an ordinary citizen of this country within the constitutional framework than hers? Could there be a more intense expression of public anguish than the prominent women of Manipur disrobing themselves in front of the Army Headquarters and shouting "Indian army rape us", this in the wake of the rape and murder of Thangiam Manorama in 2004? Can there be a more innocent movement than Anna Hazare's? But none has been able to shake the power-drunk government. On the contrary, the government has variously criminalised all these protests.

There are numerous other protests happening all over the country: the recent protests against the anti-nuclear power plants at Jaitapur (Maharashtra) and Koodankulam (Tamil Nadu); spontaneous protests of dalits in Maharashtra after the Khairlanji murders; people's nationwide protests against the Right to Education Act; the ongoing protests against corruption and black money; and those against the violation of human rights, to name just a few. All these have been spontaneous people's protests. All of them have faced criminalisation; many of them, brutal assaults. It is being subtly communicated that there is no democratic option left in the country. The arrogance of the political class has reached the level where it defiantly challenges people to seek solutions through elections, which having been reduced to be the game of money and muscle power. It is very well known that this game is beyond people's means.

Should people mutely suffer the oppression of their representatives who behave as if they have a licence to exploit them till the next election? Even after five years, what hope does the system hold for ordinary people? The defective game also stands "fixed" by the political class, which virtually bars entry of anyone outside the club. The Association for Democratic Reforms has documented data on the personal wealth and the criminal cases of the members of the political class, which exposes their character. The entire ruling class has consolidated itself against the people. It may demonstrate differences within its ranks before the public to gain legitimacy but the fact remains that its members are all one and the same. Indeed, people are left with no democratic option and hope. It is this state of "optionlessness" and hopelessness that would inevitably push people to unconstitutional methods and, as Ambedkar warned, blast off the structure of democracy our founding fathers so laboriously built.

अपने आन्दोलन का आईना सरकार और पूंजी प्रायोजित मीडिया (जीसीएसएम) के अंग्रेजी सेक्शन में देखने को आदी हो चुके, माओवादियों -वामपंथियों के शहरी समर्थकों को कई बार जनज्वार जैसी जनपक्षधर मीडिया का सच उतना ही गड़ता है, जितना सरकार को. 12 फरवरी को छत्तीसगढ़ में माओवादियों की कांगेर घाटी एरिया कमिटी द्वारा पत्रकार नेमीचंद की मुखबिरी के आरोप में हत्या की गयी थी. इस खबर को सबसे पहले जनज्वार ने 'माओवादियों ने की पत्रकार की हत्या' साक्ष्य समेत प्रकाशित किया और माओवादियों के ख्यात समर्थक वरवर राव से माफ़ी की अपील की. लेकिन जनज्वार को माओवादियों या उनके समर्थकों की ओर से कोई जवाब नहीं आया. उस पर तुर्रा यह कि खबर ही फर्जी है. कुछ पत्रकार सरीखे लोगों ने कहा कि जनज्वार अपनी बाजारू मजबूरियों और पूर्वग्रह के कारण ऐसा लिख रहा है ,तो कुछ ने कहा 'खबर सही होती तो 'हिन्दू' या 'तहलका' में जरूर छपती', मानो ये दोनों मीडिया माध्यम वामपंथियों के चंदे से चलते हैं. बहरहाल, बस्तर क्षेत्र की मीडिया ने पत्रकार नेमीचंद की हत्या के खिलाफ अपना आन्दोलन जारी रखा. आन्दोलन का असर हुआ और माओवादियों को अपनी गलती स्वीकार करनी पड़ी. माओवादियों को पत्रकारों को 24 मार्च को जंगल में बुलाकर माफ़ी मांगनी पड़ी... संपादक

हिंदी दैनिक 'नई दुनिया' से जुड़े रहे पत्रकार नेमीचंद की माओवादियों द्वारा की गयी हत्या के खिलाफ स्थानीय पत्रकारों के बहिष्कार से परेशान नक्सलियों ने अंततः दक्षिण बस्तर के पत्रकारों को जंगल बुलाकर न केवल तोंगपाल के पत्रकार नेमीचंद की हत्या की गलती स्वीकारी, बल्कि हत्यारों को सजा देने की बात भी कही.

गौरतलब है कि 12-13 फरवरी को नक्सलियों के दरभा डिवीजन कमेटी के अंतर्गत कांगेर घाटी एरिया कमेटी ने मुखबिरी का आरोप लगा कर नेमीचंद की हत्या कर दी थी. तब बस्तर के पत्रकारों ने इस घटना के विरोध में नक्सलियों के वार्ता, विज्ञप्ति आदि का बहिष्कार करने का निर्णय लिया था. घटना के बाद नक्सलियों ने क्षेत्र के पत्रकारों से संपर्क साधा और इस मुददें में बातचीत के लिए आमंत्रित किया.

होली के पूर्व 24 मार्च को दंतेवाडा-बीजापुर जिले के मध्य जंगल में आयोजित प्रेस वार्ता में पश्चिम बस्तर डिवीजन कमेटी मेंबर कमलु कुंजाम एवं महिला कमाण्डर ज्योति ने स्वीकार किया कि नेमीचंद की हत्या उच्च कमेटी को अँधेरे में रखकर कांगेर घाटी दलम के संघम सदस्यों व ग्रामीणों द्वारा बिना किसी पडताल के और सफाई का मौका दिये जाने बिना किये जाने की सूचना है. उन्होंने इस घटना की उच्चस्तरीय नेताओं द्वारा जांच किये जाने और इसके बाद दोषियों को सजा दिये जाने की बात कही.

उन्होंने यह भी कहा कि हत्यारों के अब तक चिन्हित नहीं हो पाने की वजह से ही उन्हें सजा नहीं दी जा सकी है और मीडिया को जवाब देने में विलम्ब हो रहा है. एक पत्रकार ने जब उनसे पूछा कि 'क्या हत्यारों को मृत्युदंड दिया जायेगा?" तो नक्सली नेता ने इंकार करते हुए कहा कि उन्हें पार्टी से निकाला जा सकता है. उन्होंने कहा कि नक्सली हत्या के बदले हत्या के पक्ष में नहीं हैं. हत्या की आवश्यकता वे तभी समझते हैं, जब जनयुद्ध के लिए व्यक्ति खतरा बन जाए. नक्सली प्रवक्ता ने पत्रकारों से आवेश में आकर कथित जनयुद्ध का बहिष्कार न करने की अपील की है. पत्रकार वार्ता में सात पत्रकार मौजूद थे और यह खबर कई मीडिया माध्यमों में प्रकाशित हुई है.

उनका कहना था कि यह वे बड़े नेताओें के निर्देश पर कर रहे हैं. नक्सली नेताओं ने पत्रकारों के समक्ष जेलबंदियों को मैनुअल में हिसाब से सुविधाए देने, अदालती कार्यवाही में लापरवाही करने वाले जजों को पद से हटाने, आदिवासियों को अपमानित करने वाले कथित जस्टिस के विरूद्ध आदिवासी एक्ट के तहत मामला चलाने व जेल में बंद नक्सली नेता मरकाम गोपन्ना, निर्मला, मीना, मालती, पदमा, जमली, रेखा, सगुना आदि पर दर्ज प्रकरण रदद करने की मांग रखते हुए सरकार को कलेक्टर अपहरण जैसी कार्यवाही दुहराये जाने की चेतावनी दी.

Justice plea for rape victim in Meghalaya

Shillong, March 28: Former Rajya Sabha MP Robert Kharshiing has petitioned Chief Justice of India, Justice Altamas Kabir, on the alleged gang rape of an 18-year-old in Williamnagar in Meghalaya's East Garo Hills district last year.

"Because we hail from such a remote part of this great country of ours and because it was the Father of the Nation, Mahatma Gandhi who said that India lives in its villages, I humbly request you to take up this matter with utmost urgency," Kharshiing said in his petition.

The18-year-old was allegedly gang-raped near the Sacred Heart School at Williamnagar on the night of December 13, 2012.

Around 16 alleged culprits, nine of them juveniles, were picked up by police.

That night, the girl was returning home from the venue of the Simsang festival along with two of her female friends.

While her friends managed to flee, the victim was allegedly gang-raped after she fell down as she tried to run away.

Sources today said the case was brought to the Tura fast-track court, West Garo Hills, on March 4 where charges were framed on March 20 against seven of the accused. Nine of them were minors.

Since the present judge is leaving, the sources said a new judge will be appointed and the next hearing of the case will be held on April 3.

It was reported that the girl has been shifted from Williamnagar to Tura after there were complaints from the girl's parents that family members of the accused used to taunt her.

Recently, East Garo Hills deputy commissioner Vijay Kumar Mantri had said the entire family of the rape victim shifted permanently to Tura "long back" and is at present residing in Tura with the help of the NGOs from Williamnagar in liaison with the social welfare department.

In his petition to Justice Kabir, Kharshiing also mentioned that even after 100 days following the horrific incident, the victim and her parents are still suffering from "victimisation" with the state government taking a "very callous and uncaring attitude" towards both the girl and her parents.

"It seems that one of the rapists is related to a sitting minister, which is why the case is going nowhere," the former MP alleged, adding that the parents are being threatened by surrendered militants so that they keep quiet.

"In the past decade, Meghalaya has seen over 800 rape cases, 500 of which are still pending trial in various courts. Contrary to the popular belief that women have greater control over their lives in matrilineal societies such as in Meghalaya, the condition of women seems to be no different here from the rest of the country," Kharshiing said.

In a state that boasts of women's empowerment — where women inherit property and are seen at the forefront of domestic and public life — 830 rape cases between 2002 and 2012 should have shaken the conscience of the political parties and the administration, and forced them to act, he said.

"Instead, the conviction rate remains awfully low, compensation is hardly awarded and there are only three fast-track courts dealing with rape cases," he said.
